The benefits from drones need not usurp property rights vested with title to land. State, municipalities and private landowners have the right to exclude drones from interference with their productive use and enjoyment of their property, that has always included the lower atmosphere. The FAA controls the airspace from 400 ft Above Ground Level to 62 miles above the earth. In place of simply moving fixed wing crafts up a few hundred feet to accommodate drones, the FAA instead have forced drones to occupy private space where all current terrestrial use has always happened.
